General Terms and Conditions
1. Scope
These terms and conditions apply to all contracts concerning the temporary rental of accommodations (holiday flats, houses, and apartments) for lodging purposes, as well as any additional services and deliveries provided to the customer by Top Vermieten Betreibergesellschaft mbH (Accommodation Agreement). Customer terms and conditions are not accepted unless agreed to in writing.
2. Subletting, Alternative Use
Subletting or transferring the accommodation to third parties requires prior written approval from the company. Use for non-typical purposes without permission is not permitted. Events such as castings or job interviews require prior consent and may be subject to additional charges.
3. Contract Formation, Parties, Limitation
The contract is concluded when Top Vermieten Betreibergesellschaft mbH accepts the customer’s booking request in writing. The contractual partner is the customer making the booking. The customer and the guest named in the booking are jointly liable. Claims generally expire after one year, except in cases of gross negligence, intent, or damage to life, body or health.
4. Services, Prices, Subsequent Changes
The company provides the booked services; the customer is obliged to pay the prices applicable at the time of booking. Significant changes requested by the customer require approval. The company may adjust the price accordingly.
5. Invoices, Prepayment, Default, Dunning Fees, Set-off
Invoices are payable immediately. Advance payments or security deposits may be required. Reminders are charged at a flat rate of €5. Set-off is only permitted for undisputed or legally established claims.
6. Cancellation, No-show, Early Departure
Cancellations must be made in writing. Unless otherwise agreed, the following conditions apply:
– Apartments St. Marien & Altes Konsulat: 100% charge from 1 day before arrival
– All other accommodations: 100% charge from 14 days before arrival
– Non-cancellable bookings: 100% charge from the time of booking
The company may claim higher damages. The customer is entitled to prove lesser damage.
7. Holding Periods, Withdrawal by the Company
Holding periods may be agreed. In cases of force majeure or breach of duty by the customer, the company may withdraw from or terminate the contract. Termination is also permitted in the case of improper use.
8. Room Allocation, Check-in and Check-out Times
There is no entitlement to specific accommodations. Check-in is from 3:00/4:00 p.m., check-out by 10:00 a.m. Accommodations not vacated on time may be opened and luggage stored.
9. Liability
The company is liable only for gross negligence and intent, except in cases involving injury to life, body or health. For valuables, §§ 701 ff. BGB apply. No liability is assumed for vehicles. Items left behind are stored for three months.
10. Final Provisions
Amendments must be made in writing. Place of performance and jurisdiction is Stralsund. German law applies. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
